infinitespark provides customer engagement analytics platforms and related services specifically designed for beauty salons and spa businesses. Our services include data analytics, customer insights, retention strategies, personalisation engines, and related consulting services. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice.
User Obligations
When using infinitespark services, you agree to:

If you subscribe to paid services, you agree to pay all fees and charges associated with your account. Fees are non-refundable except as expressly stated in your service agreement. We reserve the right to modify our pricing with 30 days' written notice. Failure to pay fees may result in suspension or termination of your access to our services.
Intellectual Property
The infinitespark platform, website, and all related content, including but not limited to software, text, graphics, logos, images, and data compilations, are the property of infinitespark Ltd or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without our express written permission. Any feedback or suggestions you provide regarding our services may be used by infinitespark without compensation or attribution.
Limitation of Liability
To the fullest extent permitted by law, infinitespark Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from or relating to your use of our services. Our total liability for any claims arising from or relating to these Terms or our services shall not exceed the amount you paid to infinitespark in the 12 months preceding the claim. Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so these limitations may not apply to you.
Service Availability
We strive to maintain high service availability but cannot guarantee uninterrupted access to our services. infinitespark may experience downtime for maintenance, updates, or due to factors beyond our control. We are not liable for any losses or damages resulting from service interruptions, and we reserve the right to modify or discontinue services with reasonable notice.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of Malta, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Malta. If you are a consumer resident in the European Union, you may also have the right to bring proceedings in the courts of your country of residence.
Termination
Either party may terminate these Terms at any time with written notice. infinitespark may immediately terminate or suspend your access to our services if you breach these Terms or engage in conduct that we determine is harmful to our business or other users. Upon termination, your right to use our services ceases immediately, and we may delete your account and data in accordance with our data retention policies. Provisions of these Terms that by their nature should survive termination shall remain in effect.
Modifications to Terms
We reserve the right to modify these Terms at any time by posting updated terms on our website. Material changes will be communicated to active users via email or through our platform. Your continued use of our services after such modifications constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must discontinue use of our services.
